the way the games work is:
DS1: Hey man!
DS2: hey!
DS1: Wanna play?
DS2: sure!
DS1: lets play (map which isnt supported online)
DS2: ok! (not realizing what it's doing as it isn't coded to!)
Lets play!
DS1 doesn't affect the memory or cartridge of DS2 at all
If you can offer proof that this has happened I will gladly admit your right, but until then I seriously doubt it.
Also, of course its a good idea to ban hackers - but I'm not sure how feasible it is, whats the source for this?
Pokemon hacking spoils the game for everyone, just like ACWW hacking did.
