Ness will be confirmed as not being in the game when Sakurai says he isn't.

As far as I know, everyone from SSB is returning, including Falcon and Ness.

Once Sakurai says otherwise, I'll believe it.

Most ppl are going to sayy Whaaaaa?! Due to the fact
A.Ness is gone
B.They don't know who the hell Lucas is(good thing i saw Mother 3 for the SNES*there was originally going to be a sequal/remake of this game to the N64 but since the Cube came out they canceled)

oh yeah, i forgot about captain falcon, i hope he wasn't removed, hes part of the original smash bros characters. it would be sad to not see him in the game.

And that's why it doesn't make sense.

I can almost promise you this wasn't what the conversation looked like in the production department:
"Alright, let's see here, we got all the original Smash Bros characters. We got Jiggypuff, Mario, Yoshi, Peach, Link, Fox, Bowser, Captain Falcon, etc."
"What about Ness? He's the only one you didn't mention."
"LAWL SCREW NESS"

If every other character returns, why wouldn't Ness?

we just have to wait and see what the creators of the game did, and hope that the rest of the characters they decided to include were good decisions

If they have space for tons of characters, why would they even think about being stingy on characters, you know?

If they have enough room in the end to fit Ness, why wouldn't they, and other questions of a similar meaning.

Why would they have a clone? Lucas has the same moveset as Ness. If they were going to be different, why would Ness' moveset be different? Doesn't it make more sense to have Lucas' moveset different, and keep Ness'?

You never know, really.

Ness and Lucas have a similar moveset, but they're both still somewhat distinct. At this point, anything is possible.
